Terms and Conditions of Use of electronic magazines
By subscribing to the electronic version you are entering a website owned and operated by Creative Living Media (CLM). Your entry to this website is subject to the Terms and Conditions of Use set out below. If you do not agree to be bound by these Terms and Conditions of Use you should not enter this site.
1. Copyright
ALL material including, but not limited to articles, information, data, photographs and artist's illustrations contained within CLM publications are subject to Australian and international copyright laws. Subject to the provisions of those laws you must not copy, reproduce, re-broadcast or re-transmit any material contained within a Creative Living Media publication, whether in whole or in part, by any means or attempt to deal in infringing copies taken from this site.
You may make only one copy (hard copy) of CLM material for the purpose of personal and private use only. Any copying for commercial purposes, including for distribution to third parties or other manner of use, of the CLM material is expressly forbidden without prior written permission of CLM.
2. Disclaimer and limitation of liability
You acknowledge that while CLM and all contributors to CLM publications will endeavour to ensure that the material contained within the electronic magazines and the website is accurate and up-to-date, CLM and its contributors accept no responsibility for any error or omission in relation to any material contained within this edition or the Website.
All implied warranties and conditions are excluded, except those that by operation of law cannot be excluded.
You understand that CLM does not provide advice or endorsement of any kind, and availability of material contained within the electronic magazines does not constitute a recommendation that you enter any transaction or follow any course of action. To the extent permissible at law, CLM excludes all liability for any loss or damage, which may be suffered by you by reason of reliance on this material contained within this website for any purpose or your inability to access material contained within the electronic magazines. CLM accepts no responsibility for loss resulting from viruses, internet access problems or hardware or software malfunctions.
CLM does not warrant or represent that the electronic magazines will be available at all times.
In the case of services offered to you by CLM within the electronic magazines,to the extent that CLM's liability cannot be excluded by operation of law, CLM's liability is limited to the supply of these services again or the payment of the costs of having these services supplied again.
3. Site content
To the extent third parties display material within a CLM electronic publication or website including, but not limited to, advertisements offering any goods and services for sale or otherwise, those third parties are responsible for ensuring that these goods and services do not violate any law and do not promote the email activity commonly known as spamming and the internet activity commonly known as hacking.
CLM accepts no responsibility for any material displayed on this site by any third party. To the extent permissible at law, CLM excludes any liability for such material.
4. Fees
Access to the electronic magazines is available on a pay for use basis, although CLM may in its discretion waive fees for a period. All prices quoted for subscriptions to the electronic magazines are in US or Australian dollars inclusive of GST. If you subscribe for a fixed period, and you wish to terminate your subscription before the end of that period, we will not refund you any part of the subscription price.
5. Access
Viewing access to the electronic magazines is via the internet. You must be online to view the magazine. At all times the electronic magazines remain on the publisher's agent's server. The electronic magazines are not available as a download to a hard drive. Each magazine is available as a view only file for a period of 30 days. This period may be extended at the discretion of the publisher. Viewing access is limited to two computers only. Viewing access does allow for the creation of one printed copy for your personal archives only.
